COLLECTING YOUR INFORMATION

Amplify collects Personal Information to improve the manner in which Amplify operates and offers its products and services. Amplify does not rent or sell any of the personally-identifiable information collected from you to third parties. Amplify will not share your personally identifiable information with third parties without your consent, unless such sharing is necessary for the purposes set forth in this Policy.

By using or accessing our website, software services, or mobile application ("Amplify Offerings"), you may be asked to provide Amplify certain information, categorized in this Policy as either "Personal Information" or "Public Information."

"Personal Information" means any information or opinion that can identify or reasonably identify you, or otherwise reveal your own, personal characteristics or unique data, such as your name, birth date, home address or credit card information. This information is Personal Information regardless of whether it is true or not, and whether it recorded in material form or not. Amplify will use Personal Information only in the manner described in this Policy or as otherwise expressly authorized by you, and does not solicit any sensitive information. In all cases, Amplify will protect your Personal Information from unauthorized disclosure in the same manner as it protects Amplify’s own, highly confidential information.

""Public Information"" means any information from which you cannot be identified or reasonably identified, such as aggregate Site user statistics or information regarding your Internet connectivity. Public Information will be gathered and used to help improve internal processes, products, connectivity and monitor general usage.

TYPES OF PERSONAL INFORMATION COLLECTED AND STORED

Personal Information that Amplify collects from you will depend on how you use the Amplify Offerings and the capacity in which you interact with Amplify.

(a) Customers, clients and prospective customers or clients: When you enquire about Amplify’s services or when you become a customer or client of Amplify, a record is made which includes name and email address, information about your employer or an organisation whom you represent; and any additional Personal Information you provide to us, or authorise us to collect, as part of your interactions with Amplify and/or use of the Amplify Offerings.

(b) Employees, contractors, consultants and prospective employees, contractors or consultants: Amplify collects Personal Information when recruiting personnel such as name, contact details, qualifications, and work history. Generally, Amplify will collect this information directly from the candidate. However, Amplify may also collect this information from third parties such as recruitment agencies.

(c) Visitors to the website: Amplify collects cookies from your computer (such as your device type, browser type, IP address, pages you have accessed on our websites and on third-party websites) which enables Amplify to better customise your website experience. Generally, it is not possible to identify you personally from the use of cookies and Amplify will not collect any Personal Information unless you input that information into the website.

HOW WE COLLECT YOUR INFORMATION AND WHERE IT IS STORED

We collect Personal Information through various means, including:

Direct Interactions: When you voluntarily provide information by filling out forms on our website, contacting us via email or phone, or participating in surveys. If you are a Client, during our business relationship with you.

Amplify stores all information securely on our servers (including trusted third-party cloud storage providers based in Australia and overseas). Amplify takes reasonable steps to protect your Personal Information from misuse, interference, and loss and from unauthorised access, modification, or disclosure.

We only collect and handle your Personal Information that is provided by you, with your consent or where otherwise permitted by applicable laws. We will assume that you have consented to us collecting all information that is provided to us in accordance with this Privacy Policy unless you tell us otherwise at the time you provide it to us.

Please note that if you provide us with Personal Information about a third party, you represent to us that the person agrees to us collecting and handling their Personal Information in accordance with this Privacy Policy, and we will collect it on this basis.

REASONS FOR COLLECTING PERSONAL INFORMATION

Amplify collects Personal Information reasonably necessary to carry out its business, to assess and manage customer or clients’ needs, to advertise the Amplify Offerings, and provide its services. We may also collect your Personal Information for the following purposes:

To Provide and Improve Our Products and Services: Personal information helps us deliver our products and services effectively and continually enhance your experience.

To Communicate with You: With your consent where required under applicable laws, we may use your contact information to send you updates, promotions, and news.

To Comply with Legal Obligations: We collect and store Personal Information as required by Australian laws and regulations.

ACCESSING AND CORRECTING PERSONAL INFORMATION

Amplify takes reasonable steps to ensure that any Personal Information it collects, uses or discloses is accurate, complete and up to date. You can help Amplify to do this by contacting us if you notice errors or discrepancies in information we hold about you or if your personal details change.

DISCLOSURE OF INFORMATION OUTSIDE AUSTRALIA

While we primarily store and process Personal Information within Australia, in some cases, it may be necessary to disclose your information to third parties located outside of Australia. We will only do so if it is practical and necessary to fulfill the purposes mentioned in this Privacy Policy.

We will always require your Personal Information to be treated to at least Australian standards, and by submitting your Personal Information, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

USE OF CONTENT

Subscribers designate individual end users ("Authorised Users") who are authorised to access and use the Subscriber’s account for a particular version of the Amplify Offerings ("Subscriber Account"). All information that is placed into the Amplify Offerings by either Subscribers or Authorized Users is referred to as "Content" whether such information is Personal Information or Public Information.

Subscriber Accounts are not public. Permission to view, access or use Content within the Subscriber Account is provided solely by Subscriber.

Each Subscriber Account is password protected by Subscriber. Amplify will never ask for passwords in an unsolicited phone call or e-mail. Subscribers and their Authorised Users are responsible for protecting the secrecy of passwords and any Subscriber Account log-in information.

Authorised Users may upload and store Content via the Subscriber Account in the manner designated by Subscriber. Amplify will not use, view, manipulate, alter or seek to discover any information or data within Content or otherwise monitor the nature or quality of Content without your permission.

Amplify may access, remove, segregate or quarantine Content (or a portion of Content) without prior notice or consent in the unlikely event such action: (a) is required by law; or (b) will prevent or mitigate damages caused by viral code, spyware, malware or other potentially harmful, unlawful or unauthorised materials contained within Content.

HOW DOES AMPLIFY KEEP YOUR PERSONAL INFORMATION SECURE?

Amplify protects your Content using state-of the-art technologies and a world leading cloud hosting facilities. The Site and Amplify Offerings are monitored 24x7 to ensure the Amplify infrastructure is not accessed or used by unauthorised parties.

Secure Socket Layer ("SSL") encrypted communication is required for use for all Content in Amplify Offerings. SSL is a standard format for transmitting secure Content from your computer to a Amplify server. SSL works by using a private key to encrypt Content that is transferred over the SSL connection. You will know SSL is being used when you see preceding a web address with "https" rather than "http."

Additionally, to protect your Personal Information, Amplify restricts employee access to databases containing Personal Information, imposes confidentiality requirements upon employees who do have access to databases containing Personal Information, and binds subcontractors with contractual, technical and organizational measures to further protect this information.

WHEN AND HOW DOES AMPLIFY SHARE YOUR INFORMATION WITH THIRD PARTIES?

Amplify does not sell or rent your Personal Information with a third party unless you consent to provide such information to a third party partner or content service. Amplify may share your Personal Information with our contracted service providers where it is necessary for us to provide the Amplify Offerings to you.

Amplify may disclose your Personal Information if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law; (b) comply with the order of a competent judicial authority in any jurisdiction; (c) comply with legal process served on Amplify; (d) protect and defend the rights or property of Amplify; or (e) act in urgent circumstances to protect the personal safety of users of Amplify products or the public at large.

Amplify Offerings and Site may contain links to other web sites and products. Amplify is not responsible for the privacy practices or the content of such web sites or products. USE OF COOKIES

Like other major service providers, Amplify uses cookies to provide you with a tailored experience when visiting the Site and using the Amplify Offerings. A cookie is a text file that is placed on your computer by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer.

Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you. A cookie may be sent by Amplify to your browser and potentially stored on your computer system. Your browser returns cookie information to the domain where it originated, such as the Site.

EMPLOYMENT AND RECRUITMENT

If you send us an application to be considered for an advertised position (or unsolicited), this information may be used to assess your application or suitability for employment with us.  

As part of the application process, you may be asked for your consent to the use and disclosure of certain Personal Information about pre-employment testing.  We may also ask you to consent to the disclosure of your Personal Information to those people who you nominated to provide references.  A refusal to provide any of this information, or to consent to its proposed disclosure, may affect the success of the application.

This Privacy Policy does not apply to our handling of information about our employees.  Our handling of employee records is exempt from the Australian Privacy Principles under the Privacy Act 1988 (Cth) ("the Privacy Act") if the act or practice is directly related to:

• either a current or former employment relationship between us and the individual; and

• an employee record held by us relating to the individual.

NOTIFIABLE DATA BREACHES

A notifiable data breach scheme is currently in place in Australia.  We are committed to adhering to this scheme as an important step in preventing and managing serious privacy breaches.

A "data breach" means unauthorised access to, or disclosure, alteration, loss, or destruction of, Personal Information—or, an action that prevents us from accessing Personal Information on either a temporary or permanent basis.  An "eligible data breach", in accordance with the Privacy Act, occurs when there is a data breach that is likely to result in serious harm to any of the individuals to whom the information relates and we are unable to prevent the likely risk of serious harm with remedial action.

We, including all our people, take breaches of privacy very seriously.  If we suspect a privacy breach has occurred, our priority is to contain and assess the suspected breach.  In doing so, we will:

(a) take any necessary immediate action to contain the breach and reduce the risk of harm;

(b) determine the cause and extent of the breach;

(c) consider the types of information involved, including whether the Personal Information is sensitive in nature;

(d) analyse the nature of the harm that may be caused to affected individuals;

(e) consider the person or body that has obtained or may obtain Personal Information as a result of the breach (if known); and

(f) determine whether the Personal Information is protected by a security measure.

If we believe an eligible data breach has occurred we will, as soon as practicable, notify the Commissioner and all affected individuals or, if it is not possible to notify affected individuals, provide public notice of the breach (in a manner that protects the identity of affected individuals).

GENERAL DATA PROTECTION REGULATION

We welcome the General Data Protection Regulation ("GDPR") as an important step forward in encouraging high standards of personal data security.  Australian businesses of any size may need to comply if they have an establishment in the European Union ("EU"), if they offer goods and services in the EU (irrespective of whether a payment is required), or if they monitor the behaviour of individuals in the EU (where that behaviour takes place in the EU).

Under the GDPR and the Data Protection Act 2018 (UK), we may have some additional obligations with respect to the processing of "personal data" collected from residents of the EU and/or United Kingdom ("UK").  The meaning of personal data is similar to Personal Information—however, it is broader as it includes any information relating to an identified or identifiable natural person.

Where required, we will take appropriate steps to ensure that the personal data of EU and/or UK residents is:

(a) processed lawfully, fairly and in a transparent manner;

(b) collected for legitimate purposes;

(c) accurate and up to date;

(d) kept for no longer than is necessary for the purposes for which it was collected; and

(e) secure and protected against unauthorised or unlawful processing and against accidental loss, destruction or damage.

We will comply with all obligations imposed on data importers under the GDPR and the Data Protection Act 2018 (UK) with respect to the personal data of EU and UK residents, including the Standard Contractual Clauses, to the extent that they may apply to us and our relationships with third parties.

EU and UK residents have the right to access personal data we hold about them and to request that personal data be corrected, updated, deleted or transferred to another organisation.  EU and UK residents are also able to request that the processing of their personal data be restricted or objected to their personal data being processed.  To make any of these requests, please contact our Privacy Officer.

CHANGES TO OUR PRIVACY POLICY

Over time, aspects of our business may shift as we respond to changing market conditions and legislative obligations.  This may necessitate our policies to be reviewed and revised.  We reserve the right to change this Privacy Policy and notify you by posting an updated version of the policy on our website.  In light of this, we strongly recommend that you review our Privacy Policy each time you visit or use the Amplify Offerings or provide us with any of your Personal Information.
